  1. There’s a lot of issues here.

    First of all, the recording industry got themselves into this mess by the self-imposed “parental advisory” labels. They should have stuck out the PRMC fight and not caved, then this wouldn’t have been an issue.

    But they did, so it is. So now they’re finding out how many “fucks” it takes to require a label. If this case goes how I believe it will, post-Nipplegate, then the answer to that question is “1”. They’ve made their bed, now they need to lie in it, especially if stores like Wal-mart are going to determine their purchases on the accuracy of the labelling.

    Funniest bit: the suit maintains that Wal-mart should have known the album had cursing because Walmart.com knew. It says “They are a multimillion-dollar corporation and they certainly can communicate among their various entities.” As someone who works for a multimillion-dollar corporation (and I’m sure I’ll hear a chorus of agreement) I think that status makes inter-departmental communication less likely.
