TORONTO – People who share music files on the internet are safe after a Federal Court rejected a motion on Wednesday that would have allowed the music industry to sue them.

Justice Konrad von Finckenstein said the Canadian Recording Industry Association hadn’t shown copyright infringement by 29 people who had allowed their music files to be uploaded.

Making files available in online, shared directories is within the bounds of Canadian copyright law, von Finckenstein ruled.

“No evidence was presented that the alleged infringers either distributed or authorized the reproduction of sound recordings,” von Finckenstein wrote in his 28-page ruling. “They merely placed personal copies into their shared directories which were accessible by other computer users via a P2P service.”

The Canadian Recording Industry Association last month asked the judge to order the country’s largest internet providers to release the names of 29 people who share copyrighted music through music swapping networks such as Kazaa, Grokster and Morpheus.

The music industry wants to shut down internet file sharing of music, blaming it for plummeting sales of compact discs.

Last year, the recording industry in the United States began going after people who share music online.

The Recording Industry Association of America has sued about 400 individuals in the U.S. for allowing others access to song files. Several people have settled out of court for about $3,000 US each.

On Tuesday, the recording industry sent warning letters or filed charges against 247 people in Denmark, Germany, Italy and Canada. ”

From p2pnet: File swapping has ‘zero effect’

Starting today I’ll be posting track listings here for my CDs of “loose” songs. Basically they’re songs that I burned from my older, no-longer-wanted discs before selling them, as well as songs I downloaded (quite legally though, I can assure anyone from the CRIA who happens to be reading this. Also for the CRIA’s benefit: go fuck yourselves. Have a pleasant day.). Many of the recent ones are suggestions from John Sakamoto’s Anti-Hit list or Pitchfork, many came from the stunning ether that is my life. I have no reason for doing this, and yet…here I go.

Grab your seat, concentrate, and for chrissakes don’t blink. You might miss one. No, not a mystery-revealing plot point, but one of the nuances or tiny events that make the movie feel like a piece of new precious metal, not immediately discernable from any common rock except for the small, delicate details. Those small details make all the difference in this movie, and in everything else I suppose.

Jim Carrey plays out of character here. Even his face plays out of character; no rubbery insanity, no bulging-eyes-and-steaming-ears slapstick stares, just a quiet and somewhat indifferent sadness, more like real life than most real life.

If you didn’t like Adaptation, you might not like this one either. But lord knows you should have liked Adaptation, so go see it again. Then go see this.
